Terms of Service

These terms are the agreement between you and Hive Asset Group, LLC for using Bollard Marina. Please read them. If you do not agree, do not use the service.

1. Who we are and what these terms cover

Bollard Marina is marina management software made by Hive Asset Group, LLC ("Bollard", "we", "us"). Our mailing address is 202 N. Cedar Ave., Suite #1, Owatonna, MN 55060. These terms apply to the Bollard website at bollardmarina.com, the Bollard app at app.bollardmarina.com, and the services we provide through them.

If you use Bollard for a marina, yacht club, dry stack yard or municipal harbor, you confirm that you can accept these terms for that business or public body. "You" means you and that business or body.

2. Your account and roles

Give us accurate information when you sign up and keep it current. Keep your password private. You are responsible for what happens under your account, including what the people you invite do.

Each person who works in your account has a role. An owner controls the account, billing and who else has access. A manager runs day to day work such as slips, contracts and boaters. A dockhand has mobile access to the arrival board, slip map and boater lookup, and no billing access. An accountant can read records and work with invoices. You choose each person’s role and you are responsible for keeping those roles accurate, including removing people who leave.

Boaters get their own portal login to pay, sign and update their records. A boater is your customer, not ours.

Tell us at support@bollardmarina.com right away if you think someone has used your account without permission.

3. Free trial, plans and billing

Every account starts with a 14-day free trial. We do not ask for a card to start the trial. You can add a card on file at any time, and it is charged when the trial ends. If you do not add a card, the account becomes read-only at the end of the trial until you choose a plan.

Paid plans are billed in US dollars, monthly or yearly, at the prices on our pricing page. Every plan includes every module, with unlimited slips, users and boaters:

  • Harbor: $249 per month, or $199 per month billed yearly ($2,388 per year). One marina.
  • Fleet: $449 per month, or $379 per month billed yearly ($4,548 per year). Up to 3 harbors under one account, with consolidated reporting and per-harbor permissions. Each harbor beyond 3 is $99 per month.
  • Done-for-you migration: included on annual plans, and $499 one-time on monthly plans.
  • Text messages: 500 messages per month are included, then $0.02 per message.
  • Bollard Sign (e-signature): unlimited and included.
  • Instant payout to your bank: optional, off by default, and 1% of the payout when you use it.

There is no setup fee and no contract. You can cancel at any time. Subscription billing is handled by Stripe Billing, and sales tax is added where required.

Price changes: we may change the public price of a plan for new accounts at any time. See the price lock below for what that means for you.

Past due accounts: if a payment fails, we will tell you and retry it. Your account keeps working for a 7-day grace period, with a banner in the app. If the payment is still not made after that, we may limit the account to read-only until it is fixed. Boater portal access and boater payments to your marina are not switched off for this reason.

4. The 3-year price lock

The price of the plan you choose when you sign up is written into your account record and shown on every invoice. We will not raise that price for 3 years from the date of signup, whether you pay monthly or yearly. If you change plans, the price of the new plan on that date is locked for 3 years from that date. If you cancel and later return, the then-current public price applies.

The lock covers the plan price. It does not cover taxes, pass-through charges from other companies, or the usage prices listed above for text messages and instant payout, which we may change with 30 days’ notice.

5. Boater payments and the platform fee

Boater payments run on Stripe Connect. You create a Stripe connected account from inside Bollard, and by doing so you accept Stripe’s terms for connected accounts. Stripe, not Bollard, holds card and bank details, pays out to your bank, and decides whether a payment, payout or account is allowed.

Bollard charges you a platform fee on each payment. 0.3% on card payments and 0.8% on ACH, capped at $5. Your boaters never pay a fee. The fee is shown on every transaction. Boaters pay no fee to Bollard, and Bollard does not add a fee to what a boater pays. The platform fee is taken from the payment before it reaches you. If you offer instant payout, its cost is 1% of the payout and it is off until you turn it on.

Refunds, chargebacks and failed payments are your responsibility as the merchant. If a payment is reversed, Stripe may take the amount back from your balance or bank account.

You are responsible for the amounts you charge, including seasonal contract rates, transient rates, deposits and late fees.

6. Your responsibilities as a marina

You are responsible for how you run your marina. That includes your slip contracts, rates, deposits, insurance requirements, late fees, liens, waitlist rules, rules for sublets, and every notice and message you send to boaters. Bollard gives you tools, templates and timelines. It does not give legal advice, and it does not replace your attorney.

Templates, including contract templates, demand letters and lien notice letters, are starting points. Laws on maritime liens, storage, late fees and boat sales differ by state and by harbor. Have an attorney licensed where you operate review your contracts and your process.

Insurance: Bollard stores the certificates your boaters upload and can remind you when one is about to expire. We do not check that a certificate is valid, that coverage is adequate, or that a boater meets your requirements. Deciding who may keep a vessel at your marina is your call.

Bollard Sign collects electronic signatures and keeps an audit record. Whether a contract is enforceable depends on its terms and on the law that applies, and that is for you and your attorney to decide.

You must follow our Acceptable Use Policy and the laws that apply to you.

7. Text messages and email to boaters

Texting runs through Twilio and email through Resend. You are the sender of every message you send through Bollard. You are responsible for having the consent that the law requires (in the United States, this includes the Telephone Consumer Protection Act and carrier rules), for honoring opt-outs, and for keeping records of consent. Bollard honors a boater’s reply of STOP, and you must not try to get around it. See the Acceptable Use Policy for messaging rules.

Messages are billed as described above. Carriers may block or delay messages, and we cannot guarantee delivery.

8. Your data

You own the data you put into Bollard, including your slips, boaters, vessels, contracts, documents and payment records. You give us permission to store, process and display that data only to run the service for you, keep it secure, and meet our legal duties.

You can export your data at any time, including as CSV files from the tables in the app. Boaters’ personal information belongs to your relationship with them. Our Data Processing Addendum explains how we handle it on your behalf.

We may use information about how the product is used, without boater or marina identities, to run and improve Bollard.

9. Availability and changes to the service

We work to keep Bollard available and to fix problems quickly, but we do not promise it will never be interrupted or error-free. We rely on other companies, including Stripe, Supabase, Netlify, Twilio and Resend, and an outage at one of them can affect the service. We may add, change or remove features. If we make a change that meaningfully hurts how you use a paid plan, we will tell you before it takes effect.

Some things are not part of Bollard today: point of sale, fuel dock, ship store inventory and boatyard work orders. We say so on our site so you can decide with the full picture.

10. Cancelling and what happens to your data

You can cancel at any time from the billing page. Cancellation takes effect at the end of the period you have paid for. We do not refund the unused part of a period already paid, except where the law requires it.

After your account is canceled, it stays available in read-only form for 90 days so you can export your records. After that, we delete or anonymize your data unless the law requires us to keep it. We may keep billing records for as long as tax and accounting rules require.

We may suspend or end your account if you break these terms, put the service or other customers at risk, or do not pay after the grace period. Where we can, we will warn you first and give you a chance to fix the problem.

11. Disclaimers

The service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement.

12. Limit of liability

To the fullest extent the law allows, Hive Asset Group, LLC will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost bookings or lost data, arising from your use of Bollard.

Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the event that gave rise to the claim. Some places do not allow these limits, so they may not fully apply to you.

You agree to cover losses that come from claims by boaters or other third parties about your contracts, rates, fees, liens, notices or messages, to the extent those claims are not caused by our breach of these terms.

13. Changes to these terms

We may update these terms. When a change matters, we will tell you by email or in the app before it takes effect. The date at the top of this page shows the latest version. If you keep using Bollard after a change takes effect, you accept the new terms. A change to these terms does not change a plan price that is under a price lock.

14. Governing law and disputes

These terms are governed by the laws of the state where Hive Asset Group, LLC is organized, without regard to its conflict-of-law rules. Before filing a claim, please contact us so we can try to resolve it informally.
